Bacumi.com Theme End-User License

1. Scope and acceptance

This license covers Bacumi Theme, including its Light and Dark themes, distributed under the Bacumi.com publishing name. “Publisher” means the rights holder distributing this extension under that name. Review this license before installing or using the extension. By installing or using it, you accept this license to the extent permitted by applicable law. If you act for an organization, you must have authority to accept on its behalf. If you do not accept, do not install or use it.

2. Free license grant

The Publisher grants you a non-exclusive, royalty-free license to install and use Bacumi Theme for lawful personal use and your organization's internal business purposes in Visual Studio Code. There is no license fee, subscription, license key or automatic paid renewal. You may customize its appearance through Visual Studio Code user settings for your own use. This permission does not grant a right to distribute a modified extension.

3. Ownership and restrictions

The extension is licensed, not sold. Except for the express grant, the Publisher and its licensors retain their rights. You may not sell, sublicense, redistribute or publish the extension or derivatives of its proprietary assets, remove legal notices, or use Bacumi names and marks to imply endorsement. No trademark license is granted beyond the display inherent in authorized use. Restrictions apply only to the extent permitted by law. Mandatory rights, including applicable rights to backup, study, test or achieve interoperability, remain unaffected.

4. Your code and privacy

Your code, documents and other data remain yours. This license grants the Publisher no rights in that content. The extension contains static theme definitions and images. It does not execute extension code, read project content, transmit data, collect telemetry or contact a Bacumi service. Microsoft operates Visual Studio Code and Marketplace under its own terms and privacy notices. Opening the website or contacting support is a separate, voluntary action.

5. Support and updates

Support is provided through support@bacumi.com on a reasonable-efforts basis, without a guaranteed response time, service level or update schedule. Updates may change appearance or compatibility. Discontinuation or future paid products do not retroactively create a fee for this edition. Material changes to this license will be identified by a new version or date and supplied with the relevant release; they do not silently replace the license of an earlier distributed copy.

6. Warranties and liability

To the extent permitted by applicable law, the extension is provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability or error-free operation. To the same extent, the Publisher is not liable for indirect or consequential loss, including loss of profits, interruption of business or loss of data. Nothing excludes liability that cannot lawfully be excluded, including applicable liability for fraud, intentional misconduct, gross negligence, death or personal injury. Mandatory consumer rights and statutory remedies remain unaffected.

7. Termination and third-party rights

You may end use at any time by uninstalling the extension. The Publisher may terminate the license for a material breach that remains unremedied after reasonable notice where a remedy is possible. On termination, stop using and remove proprietary extension copies you control. Third-party components retain their own licenses and notices supplied with a distribution. Development tools and preview fonts are not bundled into the extension.

8. Applicable law and contact

Romanian law and applicable European Union law govern this license, subject to mandatory protections under the law that applies to you. This does not restrict any mandatory right to bring a claim in your local courts. If a provision is unenforceable, the remaining provisions continue where legally possible.
